A Bauchi State High
Court has restrained the Speaker of the state House of Assembly,
Halliru Dauda Jika, from performing the functions of the office and
parading himself as the Speaker.
The court, presided
over by Justice Ibrahim Mohammed Zango, granted the order in a suit
filed by Abubakar Ahmed Faggo, a former Speaker of the House.
It also ordered the
Clerk of the Assembly, the Assembly, and the Attorney General of the
state from “implementing the resolution of the Bauchi State House of
Assembly made on Wednesday”, saying that the resolution infringed on
the fundamental human rights of the applicant to fair hearing.
The court also
ordered that the motion on notice be served to the respondents at least
eight clear days before the next hearing fixed for February 10.
The Assembly, on
Wednesday, in a sitting presided over by the deputy Speaker, Saleh
Abubakar Dumba, impeached Abubakar Ahmed Faggo by a two-third majority
of the lawmakers for what they described as “lack of purposeful
leadership.”
Meanwhile, the
Assembly, in a sitting presided over by Haliru Jika, removed the
Assembly Clerk for “non-performance and dereliction of duties.”
During the session,
a member, representing Kirfi constituency, Harsanu Guyuba, moved the
motion for the removal while the member Mohammed Tukur, Lere/ Bula
constituency, seconded the motion.
The legislators, however, nominated Gambo Miya as acting Clerk, pending the appointment of a substantive Clerk to the House.
