The Federal High Court in Lafia, the capital of Nasarawa State, yesterday ruled on its earlier judgement directing the Independent National Electoral Commission (INEC) to issue a certificate of returns to Solomon Ewuga, one time minister of state for the Federal Capital Territory (FCT).?
The court, in June this year, gave the ruling following a motion brought to it by Ewuga to determine the authentic candidate of Congress for Progressive Change (CPC) and the winner of last April elections as the senator representing Nasarawa North senatorial zone.?
?
?
However, the counsel to Senator Yusuf Musa Nagogo filed a motion for stay of execution, to restrain CPC and Solomon Ewuga from executing the earlier judgement.?
In the process, the counsel to Senator Nagogo, applied to withdraw the suit and replace it with an interlocutory injunction and stay of execution, which was not granted by the court.?
?
?
When the matter came up yesterday, the counsel to Senator Nagogo filed an oral application to withdraw all his applications; however, the court went ahead to strike out the case, declaring that it stood by its judgement and awarded the sum of N50,000 as damages to Ewuga, as against the N200,000 requested by his counsel.?
?
?
Both Nagogo and Ewuga were not in the court during the judgement yesterday and could not be reached for comments.?
With this ruling, INEC ?is expected to ?issue a certificate of returns to Ewuga and he will be sworn in by the Senate to represent Nasarawa north senatorial district.
?
The matter is not declearing ewuga as the winner of these case but will he be sworn in?nagogo shud’t claim someone’s victory.
