Kogi Guber: Wada Is Not PDP Member, Chieftain Tells Court

A Peoples Democratic Party (PDP) chieftain, Mr Emmanuel Abalaka, yesterday, urged a Federal High Court in Abuja to nullify the nomination of Captain Idris Wada as the party’s governorship candidate for the December 3 election in Kogi State on the ground that he is not a member of the party.

In an originating summons brought pursuant to Section 31 (2) of the Electoral Act 2010 as amended, Section 31 (5) (6) of the Electoral Act on the inherent jurisdiction of the court, the plaintiff wants the court to declare? Wada’s nomination by the PDP as null, void and of no consequence.

Abalaka, wants an order disqualifying Wada from contesting the December 3, 2011 governorship poll and an order restraining the Independent National Electoral Commission (INEC) from recognising his candidacy at the poll.

PDP and INEC are joined as respondents in the suit. Buttressing his argument on why Wada could not be a candidate in the said poll, the plaintiff said that he was not a card carrying member of PDP at the time he was nominated and alleged that he falsely claimed party membership on oath.

“The defendant (Captain Wada) has occasioned a mischievous and violent insertion of his name in the membership list of the 2nd defendant (PDP) in ward one, contrary to the electoral Act 2010

In a 19 paragraph affidavit deposed to by the plaintiff himself, he averred that the PDP wrongfully nominated Captain Wada as its candidate in the gubernatorial election.
