The Court of Appeal sitting in Benin, yesterday, affirmed the verdict of the Election Tribunal which upheld the election of the Delta State governor, Dr. Emmanuel Udaughan.
While dismissing the appeal of the Democratic People’s Party, DPP, candidate, Chief Great Ogboru, it said that the appeal lacked merit.
The court also upheld the cross-appeals filed by the People’s Democratic Party, PDP, candidate, Dr. Uduaghan and the Independent National Electoral Commission (INEC).
Ogboru, had challenged the ruling of the lower tribunal which upheld his earlier appeal against the Independent National Electoral Commission (INEC) which declaredl Uduaghan? as the winner of the April 26, 2011 governorship election in the State.
In his judgment, the President of the Appeal Court, Justice Datijo Mohammed, ruled that the grounds of appeal lacked merit and subsequently dismissed the? appeal, while the cross appeal was upheld.
