Construction giant, Julius Berger Nigeria Plc has dragged the Nigerian Electricity Regulatory Commission (NERC) to an Abuja High Court in a N25 million suit, alleging that the regulator issued it a dud cheque, which caused the company much embarrassment.
The suit also joined as defendants, Industrial and General Insurance (IGI) Plc and Unique Fusion Insurance Brokers Ltd. The suit filed by Julius Berger legal team alleged that on May 9, 2011, NERC wrote them an Ecobank cheque of N200, 000 as the agreed settlement over an electric pole and Halogen lamp, property of Julius Berger damaged by a driver of the regulatory agency, but that the cheque was returned unpaid when logged into the plaintiff’s account.
The suit claimed that on “October 5, 2010, there was a serious accident involving a Toyota Corolla car with registration number BG 454 WGA driven by one Kennedy Nwagwu of the Nigerian Electricity Regulatory Commission, along Nnamdi Azikiwe Road by Nicon Junction.” The accident caused serious damage to the street light pole of Julius Berger.
Thereafter, NERC’s insurer, (IGI) made Julius Berger an offer of N200, 000 as settlement for the damage caused the company, and wrote a cheque to them through an insurance broker (Unique Fusion Insurance Brokers) which later bounced.
