An Ogun State High Court sitting in Ilaro, the headquarters of Yewa South Local Government Area, yesterday,? ruled that the Bayo Dayo led faction of Peoples Democratic Party (PDP) has the? authority to nominate and submit list of candidates for the forthcoming local government elections in the state thereby sealing the fate of Obasanjo group to field candidates for the? elections.
The Court also restrained the national headquarters of the PDP from submitting any other candidates’ list apart from the one submitted by the state executive committee under the leadership of Dayo.
Delivering ruling? in the case instituted by the Kashamu Buruji faction of the state ex-co under Dayo, the presiding judge, Justice Mosunmola Dipeolu held that section 60 sub-section 10 of PDP constitution conferred the authority to run the affairs of the state branch of the party on the state executive committee.
The judge also ruled that the party’s constitution sets up its organs with various functions and that there was no inter-lapping of functions, hence, the National Executive Council (NEC) of the party should allow the state ex-co to perform its duties without any interference of the parent body.
Acknowledging that factions exist within Ogun PDP and that it would not be in the interest of equity, justice and fair play, the judge however, restrained the National Working Committee (NWC) of PDP from interfering in the affairs of Ogun State chapter of the party.
