Justice Husseini Baba-Yusuf of the FCT High Court on Thursday dismissed a?suit filed by?a company executive, Mr Ebere Enyi, against the?Inspector-General of Police for “obviously lacking in merit''.
Enyi, the Managing Director of Glory Dynamic Company Ltd, had filed a motion ex parte seeking an order of interim injunction restraining the?InspectorGeneral of Police from carrying out an?investigation?into the property?known as Plot 405, Cadestral Zone? BO6, Mabushi, Abuja.
A company?known as Shepherd Shield properties and Development Ltd also claimed the said property was allocated to it in 2007.
Shepherd Shield Properties and Development Company later appointed Glory Dynamic Company to manage the disputed property,
The original copy of the Right of Occupancy was found in the custody of the applicant who had earlier obtained same from AGIS under what the I-G called “suspicious circumstance’’.
The Inspector-General then commenced investigation?into the said property.
In his judgment, Baba-Yusuf, held?that he found it difficult to “align himself with the applicant’s counsel that an applicant, who is evading possible arrest for purposes of criminal investigation, can honestly and in good conscience approach the court for a restraining order meant to inhabit the power of the respondents under Section 4 of the Police Act''.
“In view of the above scandal, it is only proper to allow the respondents?to do and complete their job under Section 4 of the Police Act.
“Investigation of a criminal complaint by the police is in my view a preliminary course which may or may not result in a criminal prosecution.
“It is, therefore, my final conclusion that this application was brought in bad faith,'' Baba-Yusuf said. (NAN)
